MidnightKtchn ("we," "us") produces instrumentals that may incorporate short samples of pre-existing recordings. Some of these samples have not been formally licensed with the original rights holders. This page explains what that means for you as a buyer, and how to reach us if you believe your copyrighted material was used without permission.
Beats in this catalogue may contain samples of previously recorded audio. We do not represent or warrant that every sample has been cleared, licensed, or confirmed royalty-free by its original owner.
Your purchase licenses MidnightKtchn's own contribution to a beat — the arrangement, programming, mixing, and any elements we created ourselves. It does not transfer or warrant clearance of any third-party sample material a beat may contain, and it is not a mechanical, master use, or sync license from any underlying rights holder.
Before commercially releasing, distributing, or monetizing (YouTube, Spotify, TikTok, sync, etc.) a song built on a MidnightKtchn beat, it's on you to check whether it contains sample material and, if so, to sort out clearance yourself. Private or non-commercial use carries far less risk than anything monetized or widely distributed — visibility is generally what triggers detection.
By using a MidnightKtchn beat, you agree to hold MidnightKtchn harmless from third-party claims arising from your own distribution or monetization of a track built on it.
If you're a rights holder and believe a MidnightKtchn track uses your copyrighted work without authorization, email rocaprodd@gmail.com with the subject line "Copyright Removal Request — [Track Name]," along with:
We'll review credible requests and remove the identified track from sale within 7 business days. Removing a track isn't an admission that it infringed anything — it's just how we'd rather handle it.
Copyright law around sampling varies by country and isn't fully settled even within the U.S. (courts have disagreed on whether very short samples can ever be a "safe" amount to use). This page is a plain-language summary, not legal advice, and doesn't name a specific governing jurisdiction — treat it as a good-faith explanation of how we operate rather than a substitute for your own legal advice if you need it.
